We are pleased to share the outcome of a recent case involving our client, Christine McAuliffe, who sought justice for the untimely death of her brother, David Cains, in 2020 while under the care of the Booneville Human Development Center.
After three years of legal proceedings, the Arkansas State Claims Commission has determined that the Arkansas Department of Human Services was negligent in its care of Mr. Cains. The Commission awarded $400,000 in damages to his sister, Christine McAuliffe, for the loss of her brother.
David Cains, a 42-year-old man with severe intellectual disabilities, passed away following a physical restraint by facility staff. The initial investigation by the Department of Human Services found no evidence of maltreatment, but this ruling underscores the importance of accountability and the need for continued vigilance in the care of vulnerable individuals.
While the settlement cannot replace the loss of life, it represents a step toward justice for Mr. Cains and his family. Our firm is honored to have represented Christine McAuliffe in her pursuit of accountability and systemic change.
